اهتمت الشريعة الإسلامية الغراء منذ نزولها بحياة الإنسان وأولتها اهتمامها بالغا بل وجعلتها في أولويات المصالح والضروريات التي حرصت على تأكيدها بهدف العمل على صونها والمحافظة عليها، فقد حرمت الإعتداء على الحياة وجعلته من أكبر الكبائر، ولقدسية وسمو الحياة البشرية عن حياة المخلوقات الأخرى فالشريعة الإسلامية الغراء حرمت الإعتداء على الحياة الإنسانية وخصتها دون غيرها من المصالح والضروريات بوسائل حماية ناجعة تمنع، أو تحد إلى حد كبير من الإعتداء عليها. يأتي على رأسها عقوبة الدية والكفارة بالنسبة للقتل الخطأ، وقد خطت القوانين الوضعية قاطبة خطى الشريعة الغراء في جعل الحياة الإنسانية من أولويات المصالح والضروريات التي حرصت على تحريم الإعتداء عليها ضفاء الحماية الجنائية المشددة عليها. ذلك أن القوانين الوضعية أولت اهتماما كثيرا بالحماية الجنائية ضد جريمة القتل، للوقوف ضد هذه

الجريمة.

Research Summary:

The honorable Islamic Shari'a has paid attention and has given an extreme importance in human life since its descent but has even placed it at the top of priorities and necessities it has endeavored to assure for the purpose of its safeguarding and preservation. Hence، it has forbidden the abuse of life and made it one of the major sins. For the sancity and superiority of human live over the life of other creatures، the honorable Islamic Shari'a has deprived the aggression against human life. Moreover، human life is chosen over another of priorities and necessities to gain effective means of protection that prevent or greatly restrict the action of aggression against human life. Expiation(kaffarah) and Diyah penalties come on the top of the penalties set for wrongful death. All man-made laws have followed shari'a laws in making human life a priority of interests and necessities، which have endeavored to prohibit aggression by giving them strict criminal protection for the considerable concern man-made laws has given for the criminal protection against homicide to counter this crime.
