الجزء ١ · صفحة ٢١The >th~r al-Rab‚` b. ™ab‚b presents an early contribution of the Ib~‡‚ school in the field of Islamic scholarship، since it dates from as early as the beginning of the second /eighth century.(1) As such، the work throws light on the formation، not only of the Ib~‡‚ school of thought، but of on that other Islamic schools as well. It might even change some of the ‘facts’(2) that have long been taken for granted by many scholars about the history of Islamic thought and jurisprudence (T~r‚kh al-tashr‚` al-isl~m‚). Let us take، for the sake of this particular aspect، the question of the chronological location of the origins of Islamic fiqh. This work helps to solve the arguments among Western scholars about the chronology of the development of Islamic fiqh. It is difficult to take into account works that are lost or unavailable، except in a general and theoretical way. However، this is what Schacht did as far as the Ib~‡‚s/Kh~rij‚s were concerned، and it was part of the reasoning that decided him to fix the origins of fiqh in the early years of the second century. Schacht's views were considered to be 'problematic' by Calder، who wished to place the development in the first part of the third century.(3)
